Can wife file for cruelty in the absence of wounds ?

This is a case of my freind suffering from cruelty.Her husband used to beat herlike hell.the girl returned to her mom's home.Now she want to file for divorce & maintenance.What girl wants is to see him behind bar.But her Lawyer told her in the absence of wounds & hence in the absence of direct evidence we cannt file under IPC.Actually after last beating incidence she took her time to made up her mind to file for divorce & in the mean time the wounds gone .This incident took place in mumbai.Girl want him to suffer maximum punishment & see him behind bar.Can she proceed under IPC 498 ? What is the right way to put him behind bar? Maintenance is of least importance
